Visits, meetings and undertakings of the national leader Heydar Aliyev, for the regulation of Nagorno-Karabakh conflict between Armenia and Azerbaijan and for solution of the problems of refugees and IDPs

The greatest wish of the national leader Heydar Aliyev, who devoted his entire meaningful life to the progress of our country, for the well-being of our people was the liberation of our occupied lands. He was doing his best for achieving this task.

All problems and concerns of our compatriots expelled from their native lands by the aggression of Armenia’s armed forces had become a daily concern for Azerbaijan state, for our national leader Heydar Aliyev.
The national leader of Azerbaijan people Heydar Aliyev who used to touch upon this problem in numerous international events, has named this problem as the problem number one in the country.

During 1993-2003, there had been realized wide-range measures under the leadership of Heydar Aliyev for political solution of this problem.

The Oil Fund’s first transaction in 2001 was made to improve living and accomodation conditions of refugees and IDPs.

By the orders of the great leader Heydar Aliyev 5 out of 12 existing tent camps in the country in Bilasuvar district have been liqudated by June, 2003 and 3781 families, i.e. 17014 IDPs have been settled in the new settlements in Bilasuvar and Fizuli districts.



            The national leader of our people Heydar Aliyev:

-On 27th of June in 1998 the all-Republic conference was held under the chairmanship of Heydar Aliyev;

-On 18 May 2000 the international conference called “Progress Problems and Strategic Directions” was held with the direct participation of Heydar Aliyev;

-He held more than 20 meetings with members of public of the occupied territories, refugees and IDPs;

-On October, 9, 1998 he visited the tent camps in Bilasuvar district;

-On March 19th, 1999 he participated at the wedding parties of 4 young IDPs at the tent camps in Bilasuvar district;

-On September, 13th, 2002 he participated at the openning ceremony of the new settlement for refugees in Ashagi Aghjakend settlement of Goranboy district.

-The UN Security Council had adopted 4 Resolutions in April 30 of 1993 on peaceful and rapid solution of the conflict, liberation of territories from occupation, assistance to refugees and IDPs in return to their permanent homelands (Resolution No. 822 of April 30, 1993; Resolution No. 853 of July 29, 1993; Resolution No. 874 of October 14, 1993; Resolution No. 884 of November 11, 1993;

-The reached ceasefire agreement in May 1994 gave great opportunities for restoration of stability in the country, economic growth of Azerbaijan, increasing the defence capabilities of the state;

-The measures have been taken  in the direction of peaceful and political solution of the conflict at Budapest Summit of 1994, Lisbon Summit of 1996, and Istanbul Summit of 1999 of OSCE;

-The implementation of the Clause amending No.907 of USA Congress, prohibiting the humanitarian assistance to independent Azerbaijan had been stopped in January of 2002.

- In relation with the Nagorno-Karabakh conflict between Armenia and Azerbaijan there were held 25 meetings with the President of Armenia, more than 200 meetings with the OSCE leadership, with the representatives of Minsk Group, and also more than 500 meetings with the heads of states of more than 80 countries.

-According to the Decree of September 17, 1998 of the President of the Republic of Azerbaijan, the long-term State Programme on “Solution of the problems of refugees and IDPs” was approved.

-This problem was announced as the problem number one in the country.

-The volume of the aid rendered for the solution of social problems of refugees and IDPs has risen 90 times, compensation for food has risen 60 times, financial aid for utility services payments has risen 120 times in between 1993 and 2003.

-the IDPs at the state higher and technical education institutions have been freed from tuition fees, utility payments and payments for other services.

-Although there were many economic problems in the country, the Azerbaijani national leader was directing any possible economic opportunity to the solution of social problems of the refugees and IDPs, and he has mobilized all his capabilities for the political solution of the conflict. Thanks to the successful external policy of the national leader Heydar Aliyev, the attitude of the international community has shifted towards Azerbaijan’s position, the more accurate international understanding of the problem has been achieved and Azerbaijan has strengthened its positions. By this, he once more proved to the international community that this is the number one problem of Azerbaijan state and people and needs an adequate attention.

 

Decrees and orders on financial allocations from the State Oil Fund

From the first moment, the oil strategy founded by the national leader Heydar Aliyev started bearing its fruits, as in any other spheres, the large-scale measures were taken for the social protection of refugees and IDPs. According to the Decree 562 of August 22, 2001 on “Solution of the Settlement Problems of Azerbaijanis Expelled from Their Historic Lands in the Territory of Armenia as a Result of the Policy of Ethnic Cleansing by the Armenian Nationalists” 1330 houses, number of social objects has been constructed by the means allocated from the State Oil.
According to the Decree 562 of August 22, 2001, the Agency on Restoration and Reconstruction of Territories of the Republic of Azerbaijan Exempted from Occupation as the customer organization has built settlements of 364 houses in Ashaghi Aghjakend settlement of Goranboy district, 126 houses in Shamkir district, 65 houses in Yevlakh city, 108 houses in Mehdiabad settlement of Absheron district, 160 houses in Ramana settlement of Sabunchu district, a four-storey building with 48 flats and 153 residential houses in Nakhchivan AR, two-storey building with 14 flats and 2 residential houses in Sumgayit city, 17 residential houses in Aghstafa district, 45 residential houses in Ismayilli district, 3 residential houses in Baku, 3 residential houses in Oghuz district, 2 residential houses in Sheki city, and 1 residential house in Gedebey district in total 1011 buildings – 949 residential houses and 2 block buildings with 62 flats.
The incomplete construction of 319 residential houses in 18 districts since 1995 has been completed and given to the refugees.
Also, 170 refugee families consisting of 793 people, expelled from Armenia, who had exchanged their houses and flats to the illegally built houses in Baku and permanently settled there, were granted registration, 3823 families consisting of 24385 people were given registration certificate and the refugees expelled from Armenia in 1988-1992 were granted the property right without indemnity for the state land under the buildings where they are permanently settled.
According to the Decree  577 dated 7 September 2001 on “Some Measures for the Settlement of a Part of IDPs Expelled from Aghdam and Fizuli Districts and Temporarily Settled at Tent Camps in the Territory of these Districts”  the State Oil Fund allocated means for construction of 4 settlements for 500 families in Aghdam district and 4 settlements for 800 families in Fizuli. The construction works was completed in November 2003  and the State Commission realised  the transfer of the IDPs to the new settlements:

According to the Decree N 700 dated 13 May 2002 on “Some Measures for Improving of Living Conditions of IDPs settled in 5 Tent Camps in Bilasuvar District” construction of 19 settlements for IDPs, consisting of 3781 residential houses (6 settlements for 1221 families in Fizuli district and 13 settlements for 2560 families in Bilasuvar district) with all necessary infrastructure was realized  by the financial means allocated from the State Oil Fund and transfer of IDPs to their new homes had been completed on November, 2003.  Five tent camps in Bilasuvar have been liquidated:
In general, by 74 million USD  allocated from the State Oil Fund according to 3 Decrees of the national leader of Azerbaijan people Heydar Aliyev in a very short time  6411 residential  houses with 400 thousand square metres of total  area, 18 schools for 3150 pupils, 18 kindergartens, 16 medical stations, as well as 195 kilometres of paved roads, 188 kilometres of  water pipeline, 350 kilometres of electricity transmission lines, 133 kilometres of irrigation water pipelines and other social objects have been constructed and given to exploitation.

Refugees, IDPs and local people comprising more than 35 thousand persons were employed in construction of those settlements.

Each family moved in to new settlements were given garden and land allotments and according to the resolution  No. 182 of November,19, 2002 of the Cabinet of Ministers they were given financial aid without indemnity for to be engaged in agriculture.

Legislative acts adopted in relation with social protection of refugees and IDPs

According to the Decree of September, 19, 1989 of Supreme Soviet Presidium of Azerbaijan SSR the State Committee of Azerbaijan SSR was established to deal with the process of reception, settlement and well-being of the persons who had been forced out of their permanent inhabited localities and for coordination of the work of soviet, enterprise, administrative and public organisations in this sphere. On 5 January 1993 according to the Decree No. 396 of the President of the Republic of Azerbaijan, the name of the Committee has been changed to the State Committee on Affairs of Refugees and IDPs. The new regulation for the Committee was set by the order No. 187 of February 1, 2005 of the President of the Republic of Azerbaijan.

For the aim of operative solution of  the problems of refugees and displaced persons and  for coordination of  this work from a single centre the new position of the Chairman of the State Committee on Affairs of Refugees and IDPs has been established in the structure of the Cabinet of Ministers  according to  the Decree of the President of the Republic of Azerbaijan in 1998. There was established the department of the problems of refugees and IDPs, migration and cooperation with the international organisations in the structure of the Cabinet of Ministers.

The Republic of Azerbaijan joined the UN Convention of 1951 For Status of Refugees  in 1992 and Protocol of 1967 as appendix to that Convention.

There were adopted several laws and rules, including  the Laws on “The Citizenship of the Republic of Azerbaijan” in 1998, on the “Status of Refugees and IDPs (internally displaced persons)”  in 1999, on the “Social Protection of IDPs and People Observed as Equal to Them”; as well as the rules according to the President’s  appropriate  Decree  - “Rule on Consideration  of Appeals  for  Refugee Status”.  Besides, the Cabinet of Ministers of the Republic of Azerbaijan  has approved  the rules on the “Right of Refugees and IDPs (internally displaced persons)  to  Live in Specially  Allocated  Places until Getting  a Job or Place to Live” and  on the “Right of the Persons who Submitted Appeals for Refugee Status to  Live at the Place of Temporary Settlement”.

The President the Republic of Azerbaijan  has signed the Order  N895 on the “State Programme for the Solution of the Problems of Refugees and IDPs” dated 17 September 1998, the order N 298 dated 1 July 2004 on “The State Programme for Improving  the Living Conditions of Refugees and IDPs and Increasing their Employment”.  The President has also signed Order N 2475 in 2007, October, 31 and Order N 1346 in 2011, February, 21 on “The Additional Measures for Improving the Accomodation Conditions of Refugees and IDPs” which constituted an addition to the State Programme.

As the result of the realised measures in the past years the above mentioned State Programmes, their additions and other legislative acts have been implemented successfully and the work is continuing in this sphere.

 

 


 

Decree of the President of the Republic of Azerbaijan on the mass deportation of the Azerbaijanis from their historical-ethnic lands in the territory of the Armenian SSR in 1948-1953

As a result of the policy of ethnic cleansing and genocide conducted purposefully against the Azerbaijanis in the Caucasus in the recent two centuries, our people have been subjected to grave deprivations, national tragedy and sufferings. As a result of this inhumane policy implemented into life in stages the Azerbaijanis have been driven from the territory now called Armenia, where they lived for thousands of years, from their historical-ethnic lands, subjected to mass murders and slaughters. Thousands of historical-cultural monuments and habitations have been destroyed and turned into ruins.

The resolutions of the Council of Minister of the USSR dated December 23. 1947, No 4083, and March 10. 1948, No 754, were the regular acts of historical crime committed against the Azerbaijani people. In conformity with these resolutions over 150 000 Azerbaijanis were exiled by violence in mass form from their ancestral lands in the territory of the Armenian SSR. The execution of these resolutions, which contradicted mere legal norms, was accompanied with a wide application of existing methods of repression of the authoritarian-totalitarian regime. As a result, thousands of people, including the old and infants could not bear the conditions of hard deportation, sudden changes of climate, physical shocks, and perished. The anti-national position of the then administration of the republic, its participation in the organization and execution of these bloody crimes did not play a less role than that of the chauvinistic circles of the Armenians and the criminal policy of the USSR administration in the implementation of this criminal resolution.

Unfortunately, the fact of deportation of the Azerbaijanis from the territory of the Armenian SSR in 1948-1953 has not been duly investigated in the recent 50 years and it has not received its due legal and political appreciation.

Taking the above-indicated into account,

                              I resolve:
1.  A state commission shall be instituted for the comprehensive investigation of the fact of the mass deportation of the Azerbaijanis in 1948-1953 from their historical ethnic lands in the territory of the Armenian SSR. for the legal and political appreciation of this historical crime committed against the Azerbaijani people on the state level and for its delivery to the world public.
2. The Cabinet of Ministers shall be charged to solve the issues connected with the execution of This Instruction.
